DECLARATION

• Participants of 18 years and above: I certify that I have read and accept the terms and conditions listed below.
• Participants under 18 years: I certify that I am the parent / guardian of this participant who is under 18 years and I give my consent for them to participate in this event. I accept the terms and conditions listed below for participation in this event on behalf of the participant and declare them as proficient in completing the event.

TERMS & CONDITIONS

1. By agreeing to these terms and conditions, all participants will discharge event organizers from all claims connected with participation. Participants assure the event organizer, sponsors, volunteers, and employees involved in this event directly or indirectly against all liability for any and all injury, loss or damage connected with the participant’s participation.
2. For a participant to be valid, he/she must complete the entry form, accept the terms and conditions and pay the required entry fee prior to the start of the event.
3. Participation is only valid for the details listed on the event description and is not transferable and not refundable.
4. By entering this event, participant’s consent to their personal information being:
   • Recorded and tracked by Lakwatcha Enterprises. You further accord to receiving information about Lakwatcha Enterprises’ events and special offers and promotions.
   • Provided to the Lakwatcha Enterprises timing services for the purposes of processing results.
   • Used by Lakwatcha Enterprises for media publication and announcement of results.
5. Participants consent to royalty-free use of their name, results, images, photographs, videos and comments in any publications and marketing in relation to this event by the event organizers.
6. Participants accept that participation in this event is at their own risk and they accept that participating in this event may involve real risk of injury or death including but not limited to: over exertion, dehydration and accidents with other participants, spectators or road users.
7. Participants declare that they are physically fit and capable of participating in this event. They are not aware of any medical condition or impairment that will prevent participation in this event or will affect their health by participation. If a participant becomes aware of any such condition or impairment or they are injured or sick prior to the event, they have the opportunity to withdraw but no refunds will be made. All participants will provide event organizers details of any medical or other condition that may be relevant should medical treatment be required or may affect their participation in the event.
8. Participants agree to abide by any advice given by the event first aid officers regarding their health and consent to receive and pay for any medical treatment, including transport by ambulance, required before, during or after the event.
9. Participants acknowledge that should they withdraw for a non-medical reason or should the event be cancelled or changed due to reasons beyond the control of the event organizers such as safety reasons or extreme weather conditions, the entry fee is non-refundable and not transferable.
10. Giveaways from sponsors can be claimed as long as they are still available. Bibs, race kits, and other claimable materials before the event can be claimed. Finisher shirts and medals can only be claimed after the event and if a participant finishes the race successfully. If in any case, race kits, finisher shirts and medals run out, event organizers must give the participant a replacement after event organizers already have replacements.
11. Participants acknowledge that refunds or transfer of entries will only be made up to 7 days prior to the event and will only be given for a medical reason supported by a medical certificate. In this case a PHP250.00 admin fee will be deducted and if a race pack has been sent out, the participant must return it to the event organizer at his or her own expense prior to refund or transfer being processed.
12. Participants must wear the official race bib, clearly visible on the front of the torso at all times during the event. Failure to do so may result in a participant not being recorded correctly in event results.
13. Participants consent to follow all directions by event organizers and remain on the designated course as marked and directed by marshals.
14. Participants must walk, run, bike unassisted. Skateboards, scooters, rollerblades, motorized bike or motorcycles or similar items are prohibited. Those with strollers and non-racing wheelchairs are requested to start from the back of the field. Strollers and similar devices must be safe and are conditioned for racing event.
15. Pets are not permitted, except in case of assistance dogs. Participants with assistance dogs must advise the event organizers upon entering the event.
16. Participants guarantee event organizers for any loss or damage to personal property left at the event area or bag drop area. People leave belongings at own risk.
17. Cut off times will apply. Any participant who is unable to complete the course by the cut off time may be asked to leave the course by event organizers.
18. While every effort is made to accurately record and publish results, participants accept that a small number of errors may occur. Where possible, verified timing errors would be corrected.
19. Prizes will be awarded to valid participants crossing the finish line in the designated categories and finishing positions detailed online at Lakwatcha Enterprises’ website and official social media pages. To be awarded one of the prizes, participants must be registered by the event organizer and must present themselves at the presentation ceremony to claim their prize.
20. All participants caught to be cheating; e.g. tampering RFID chips, passing RFID chips to someone, not following routes and rules, taking shortcuts, riding motorized vehicles, and all sorts of dishonesty will be disqualified automatically.

Waiver

• I fully understand that participating in this kind of event is possibly risky, and that I should not participate unless I am medically inclined, trained, and motivated.
• I full accept complete responsibility for any injury, accident, or even death that may occur while I am travelling to or from the event, during the event, or while I am on the boundary of the event. I am also aware of and assume all risks associated with participating in this event, including contact with other participants, effect of weather, traffic, and conditions of the road and my personal and/or medical condition.
• Me and in behalf of my added participants and executors, hereby waive, release and forever discharge, Lakwatcha Enterprises, staff, volunteers, the sponsors, promoters and each of their agents, representatives, and all other persons associated with the event, for any and all my liabilities, claims, actions, or damages that I may now or in the future have against them appearing out of or in any way associated with my participation in this event. I hereby grant full permission to any and all of the above parties to use any photos, video clips, website images, social media posts, and other promotional materials for this event.
• I also understand that any registration fees charged are non-refundable and are non-transferable.
